Terms & Conditions

Midnight Access provides curated DJ booking services for private events, nightlife venues, weddings, student events, corporate functions, birthdays, and other entertainment experiences. All bookings are managed directly through Midnight Access. DJs performing at events are representatives of Midnight Access.

All bookings submitted through Midnight Access are subject to review and confirmation. A booking is only considered confirmed once: • The event has been approved by Midnight Access • A deposit has been successfully paid • A confirmation has been issued by Midnight Access Midnight Access reserves the right to approve, decline, or cancel booking requests at its discretion.

All payments are processed securely through Stripe using accepted debit or credit cards. Deposit Requirements A deposit is required to secure all bookings. Remaining Balance The remaining balance must be paid in full no later than 24 hours before the scheduled event time. Failure to complete payment within this timeframe may result in cancellation of the booking without refund of the deposit.

Client Cancellations • Cancellations made 48 hours or more before the event are eligible for a 50% deposit refund • Cancellations made between 48 hours and 12 hours before the event are non-refundable • Cancellations made within 12 hours of the event are not accepted and the booking will be considered final

In the rare event that a scheduled DJ becomes unavailable, Midnight Access will make reasonable efforts to provide a suitable replacement DJ of similar quality and experience. If a replacement cannot be arranged, Midnight Access will communicate directly with the client to determine an appropriate resolution. Midnight Access is not liable for circumstances outside of its reasonable control, including emergencies, illness, weather conditions, venue restrictions, or technical failures.

Midnight Access may provide DJ equipment if agreed upon in advance. Unless otherwise stated, the following remain the responsibility of the client and/or venue operator: • Venue sound systems • Speakers • Lighting • Power access • Security • Internet access • Venue accommodations Clients are responsible for ensuring the venue is safe, accessible, and suitable for performance.

Clients are financially responsible for any damage caused to DJ equipment, sound equipment, or related property during the event caused by guests, attendees, venue staff, or any individual associated with the event. Midnight Access reserves the right to seek compensation for repair or replacement costs where applicable.

Midnight Access reserves the right to refuse or terminate services where: • Unsafe conditions are present • Harassment or abusive behavior occurs • Illegal activity is taking place • The environment presents a risk to staff, DJs, guests, or equipment No refund will be issued in these situations.

Clients may provide music preferences, genres, playlists, and requests prior to the event. While Midnight Access strives to satisfy event expectations, musical performance and crowd interaction remain subjective. Refunds will not be issued based on personal preference, musical taste, or atmosphere-related concerns once services have been provided.

Unless requested otherwise in writing before the event, Midnight Access reserves the right to use event photos, videos, and performance content for promotional, marketing, and social media purposes.

Midnight Access shall not be held liable for: • Venue issues • Guest behavior • Technical interruptions outside our control • Delays caused by the client or venue • Force majeure events including weather, emergencies, outages, or government restrictions To the maximum extent permitted by law, liability shall be limited to the amount paid directly to Midnight Access for the booking.

Midnight Access reserves the right to refuse service, cancel bookings, suspend accounts, or remove users from the platform at its discretion where necessary to protect the business, staff, DJs, or brand reputation.

These Terms & Conditions shall be governed and interpreted in accordance with the laws of Ontario, Canada. Any disputes arising from services provided by Midnight Access shall be subject to the jurisdiction of Ontario courts.

Midnight Access reserves the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the platform or services constitutes acceptance of any updated terms.
